PCNs are issued by councils under the Traffic Management Act 2004 and are enforceable penalties. Private parking charges are issued by private companies under POFA 2012 and are essentially invoices for breach of contract. The appeal processes and your rights differ significantly between the two.
For council PCNs, you typically have 28 days from the Notice to Owner for an informal challenge, or 28 days from rejection for a formal appeal. For private charges, you should appeal within 28 days of the initial notice. Acting quickly preserves your discount period and strengthens your position.
Key evidence includes photos of unclear signage, machine faults, your vehicle's position, timestamps, witness statements, medical letters for emergencies, and any documentation showing circumstances beyond your control. Photos should be clear, dated, and show the full context.
Yes, generally paying a parking charge is considered an admission of liability and ends your right to appeal. However, there are rare exceptions for double charges or administrative errors. Always appeal before paying if you believe the charge is unfair.
You can usually progress to a formal appeal: POPLA for private charges or the Traffic Penalty Tribunal for council PCNs. These are independent adjudication services. If rejected there, enforcement action may begin, but you may still have options through the courts in exceptional circumstances.
